Kabul ve Kapsam
Bu Kullanım Koşulları ("Koşullar"), Berk Cengiz Şahıs Şirketi ("Şirket", "biz") tarafından sunulan Gymora mobil uygulamasının ("Uygulama") kullanımını düzenlemektedir.
Uygulamayı indirerek, yükleyerek veya kullanarak bu Koşulları kabul etmiş sayılırsınız. Koşulları kabul etmiyorsanız, Uygulamayı kullanmayınız.
Hizmet Tanımı
Gymora, aşağıdaki hizmetleri sunan bir fitness ve spor salonu yönetim platformudur:
- Spor salonu sahiplerine: Salon yönetimi, üye takibi, ders planlama, antrenör yönetimi ve abonelik yönetimi
- Antrenörlere: Ders programı yönetimi, üye takibi, antrenman planı oluşturma ve üyelerle uygulama içi mesajlaşma
- Üyelere: Salon arama, ders rezervasyonu, antrenman takibi, vücut ölçüm analizi ve antrenörlerle uygulama içi mesajlaşma
Hesap Oluşturma ve Güvenlik
- Uygulama hesabı oluşturmak için 13 yaşından büyük olmanız gerekmektedir.
- Hesap bilgilerinizin doğruluğundan ve güncelliğinden siz sorumlusunuz.
- Hesap şifrenizin güvenliğinden siz sorumlusunuz; üçüncü kişilerle paylaşmayınız.
- Hesabınızda yetkisiz erişim fark ederseniz derhal bize bildirin.
Abonelik ve Ödeme
Gymora, spor salonu sahipleri için ücretli abonelik planları sunmaktadır.
- Abonelikler Apple App Store veya Google Play üzerinden işlenir.
- Abonelik ücretleri Apple/Google hesabınızdan tahsil edilir.
- Abonelikler, iptal edilmedikçe otomatik olarak yenilenir.
- İptal işlemi, mevcut dönemin sonunda geçerli olur; kalan süre için iade yapılmaz.
- Ücretsiz deneme süresi sonunda abonelik otomatik olarak başlar.
📌 Abonelik yönetimi için: iPhone → Ayarlar → Apple Kimliği → Abonelikler veya Google Play Store → Abonelikler bölümünü kullanın.
Uygulama İçi Mesajlaşma
Gymora, antrenörler ve üyeler arasında doğrudan iletişim sağlayan bir uygulama içi mesajlaşma özelliği sunmaktadır.
- Kullanım amacı: Mesajlaşma özelliği yalnızca fitness ve antrenman ile ilgili iletişim için kullanılmalıdır.
- İçerik güvenliği: Gönderilen tüm mesajlar içerik sanitizasyonuna tabi tutulur; zararlı içerik (script injection, XSS) otomatik olarak engellenir.
- Hız sınırı: Spam önlemek amacıyla kullanıcı başına dakikada maksimum 30 mesaj gönderilebilir.
- Gizlilik: Mesaj içerikleri yalnızca konuşma katılımcıları tarafından görüntülenebilir. Mesajlar Türkiye’deki (İstanbul) sunucularımızda güvenli şekilde saklanır.
- Mesaj silme: Kullanıcılar yalnızca kendi gönderdikleri mesajları silebilir (yumuşak silme).
⚠️ Mesajlaşma özelliğinin taciz, spam, yasa dışı içerik paylaşımı veya ticari reklam amacıyla kullanılması kesinlikle yasaktır. İhlaller durumunda hesap askıya alınabilir.
Veri ve Altyapı
Gymora’nın sunucuları, veritabanı, yüklediğiniz fotoğraf ve medya dosyaları ve canlı ders video sunucusu Türkiye’de (İstanbul) bulunan veri merkezinde çalışır.
Anlık bildirim, e-posta, Google/Apple ile giriş, uygulama içi abonelik doğrulama, ağ güvenliği ve video oynatma gibi bazı işlevler yurt dışındaki hizmet sağlayıcılar üzerinden çalışır. Hangi sağlayıcıya hangi verinin, hangi amaçla iletildiği Gizlilik Politikası ve KVKK Aydınlatma Metni’nde açıklanmıştır.
Kullanıcı Yükümlülükleri
Uygulamayı kullanırken aşağıdaki kurallara uymanız gerekmektedir:
- Yasalara ve bu Koşullara aykırı davranmamak
- Başkalarının hesaplarına yetkisiz erişim girişiminde bulunmamak
- Yanıltıcı, hakaret içeren veya uygunsuz içerik paylaşmamak
- Mesajlaşma özelliğini taciz, spam veya yasa dışı amaçlarla kullanmamak
- Uygulamanın teknik altyapısına zarar vermemek veya müdahale etmemek
- Otomatik veri toplama araçları (bot, scraper vb.) kullanmamak
Fikri Mülkiyet
Uygulama ve içeriği (tasarım, kod, görseller, metinler) Berk Cengiz Şahıs Şirketi'ne aittir ve telif hakkı ile korunmaktadır.
Kullanıcıların yüklediği içerikler (profil fotoğrafları, salon görselleri, mesajlar) üzerindeki haklar kullanıcıya aittir; ancak Uygulama hizmetlerini sunmak amacıyla bu içerikleri kullanma hakkını bize vermiş sayılırsınız.
Hesap Silme
Hesabınızı istediğiniz zaman uygulama içinden silebilirsiniz:
- Profil menüsünden "Hesabımı Sil" seçeneğini kullanın.
- Hesap silme işlemi 30 gün içinde kalıcı hale gelir.
- Bu süre içinde tekrar giriş yaparsanız hesabınız kurtarılabilir.
- Hesap silindiğinde tüm mesajlaşma geçmişiniz de kalıcı olarak silinir.
- Aktif aboneliğiniz varsa, aboneliğinizi ayrıca Apple/Google üzerinden iptal etmeniz gerekmektedir.
Sorumluluk Sınırlaması
- Uygulama "olduğu gibi" sunulmaktadır; kesintisiz veya hatasız çalışma garantisi verilmemektedir.
- Uygulama üzerinden sunulan fitness ve sağlık bilgileri profesyonel tıbbi tavsiye niteliği taşımaz.
- Spor salonu sahipleri ile üyeler arasındaki ilişkilerden Şirket sorumlu değildir.
- Kullanıcılar arasındaki mesajlaşma içeriklerinden Şirket sorumlu değildir.
- Uygulama kullanımından kaynaklanan dolaylı zararlardan Şirket sorumlu değildir.
Değişiklikler
Bu Koşulları zaman zaman güncelleyebiliriz. Önemli değişiklikler Uygulama içi bildirim veya e-posta ile bildirilir. Güncelleme sonrasında Uygulamayı kullanmaya devam etmeniz, değişiklikleri kabul ettiğiniz anlamına gelir.
Uygulanacak Hukuk
Bu Koşullar Türkiye Cumhuriyeti yasalarına tabidir. Uyuşmazlıklar Türkiye mahkemelerinde çözümlenecektir.

Acceptance and Scope
These Terms of Service ("Terms") govern the use of the Gymora mobile application ("App") provided by Berk Cengiz (Sole Proprietorship) ("Company", "we").
By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
Service Description
Gymora is a fitness and gym management platform offering the following services:
- For gym owners: Gym management, member tracking, class scheduling, trainer management, and subscription management
- For trainers: Class schedule management, member tracking, workout plan creation, and in-app messaging with members
- For members: Gym search, class reservations, workout tracking, body measurement analysis, and in-app messaging with trainers
Account Creation and Security
- You must be at least 13 years old to create an account.
- You are responsible for the accuracy and currency of your account information.
- You are responsible for the security of your password; do not share it with third parties.
- Notify us immediately if you notice unauthorized access to your account.
Subscriptions and Payments
Gymora offers paid subscription plans for gym owners.
- Subscriptions are processed through Apple App Store or Google Play.
- Subscription fees are charged to your Apple/Google account.
- Subscriptions automatically renew unless cancelled.
- Cancellation takes effect at the end of the current period; no refunds for remaining time.
- After any free trial period, the subscription begins automatically.
📌 To manage subscriptions: iPhone → Settings → Apple ID → Subscriptions, or Google Play Store → Subscriptions.
In-App Messaging
Gymora provides an in-app messaging feature enabling direct communication between trainers and members.
- Intended use: The messaging feature should be used solely for fitness and training-related communication.
- Content security: All sent messages are subject to content sanitization; harmful content (script injection, XSS) is automatically blocked.
- Rate limiting: To prevent spam, a maximum of 30 messages per minute per user is enforced.
- Privacy: Message contents are viewable only by conversation participants. Messages are securely stored on our servers in Türkiye (Istanbul).
- Message deletion: Users can only delete messages they have sent (soft delete).
⚠️ Use of the messaging feature for harassment, spam, illegal content sharing, or commercial advertising is strictly prohibited. Violations may result in account suspension.
Data and Infrastructure
Gymora’s servers, database, the photos and media files you upload and the live-lesson video server run in a data centre in Türkiye (Istanbul).
Some functions, such as push notifications, email, Google/Apple sign-in, in-app subscription validation, network security and video playback, work through service providers outside Türkiye. Which provider receives which data, and why, is explained in the Privacy Policy and the KVKK notice (Turkish).
User Obligations
When using the App, you must comply with the following rules:
- Do not violate any laws or these Terms
- Do not attempt unauthorized access to other users' accounts
- Do not share misleading, offensive, or inappropriate content
- Do not use the messaging feature for harassment, spam, or illegal purposes
- Do not damage or interfere with the App's technical infrastructure
- Do not use automated data collection tools (bots, scrapers, etc.)
Intellectual Property
The App and its content (design, code, images, text) belong to Berk Cengiz (Sole Proprietorship) and are protected by copyright.
Users retain rights to content they upload (profile photos, gym images, messages); however, you grant us the right to use this content for the purpose of providing the App's services.
Account Deletion
You can delete your account at any time from within the App:
- Use the "Delete My Account" option from the profile menu.
- Account deletion becomes permanent within 30 days.
- If you log in again during this period, your account may be recovered.
- When your account is deleted, all your messaging history will be permanently deleted.
- If you have an active subscription, you must separately cancel it through Apple/Google.
Limitation of Liability
- The App is provided "as is"; no guarantee of uninterrupted or error-free operation is given.
- Fitness and health information provided through the App does not constitute professional medical advice.
- The Company is not responsible for relationships between gym owners and members.
- The Company is not responsible for message content exchanged between users.
- The Company is not liable for indirect damages arising from use of the App.
Changes
We may update these Terms from time to time. Significant changes will be communicated through in-app notifications or email. Continued use of the App after updates constitutes acceptance of the changes.
Governing Law
These Terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved in Turkish courts.
